This policy explains how ARKNA PTY LTD (ABN 46 692 660 165) (“Arkna”, “we”, “us”) handles personal information. We handle personal information in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth). Information provided to us under an agreement with a customer is handled in accordance with that agreement.

We may collect your name, contact details, organisation and role, the content of your communications with us, and information about how you use our website.

We collect personal information directly from you, for example when you contact us, subscribe to updates or meet with us. We may also collect it from publicly available sources and from third parties, such as professional networks, events and people who introduce us, and automatically when you use our website.

We use personal information to respond to enquiries, provide information and services you request, communicate with you about our work, operate and improve our website, and comply with our legal obligations. You may opt out of receiving marketing communications from us at any time by using the unsubscribe option in our emails or by contacting us.

We may disclose personal information to service providers who support our business, such as hosting, email, data storage and analytics providers, to our professional advisers, and where required or authorised by law.

Some of our service providers may store or process personal information outside Australia, including in the United States and Japan.

These terms govern use of the Arkna website and, where a separate order or master agreement does not apply, the Arkna service. Where a signed agreement exists, it prevails over these terms.

Arkna produces a technical evidence record of AI agent activity. Arkna does not provide legal, regulatory, or compliance advice, and does not certify compliance with any framework. Frameworks referenced across this site (EU AI Act, ISO/IEC 42001, NIST AI RMF, APRA CPS 230/234, TGA) are standards Arkna maps evidence to, not certifications Arkna holds.

Use the service only for lawful purposes and in line with your agreement. Don't attempt to compromise the integrity of records, the hash chain, or other customers' data.

You retain ownership of the records you capture. You grant Arkna the limited rights needed to operate the service for you. Deletion and export are governed by your agreement.

The service is provided "as is" except as set out in a signed agreement. Warranty, service-level and support terms are governed by your master agreement where one is in place.

Liability and indemnity are governed by your master agreement. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.

These terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
